By using the website https://more.beingdeveloper.com (the “Website”) or any other BeingDeveloper services to which these terms apply (as defined below), you agree to all the terms and conditions of these Terms of Use (the “Terms of Use”). These Terms of Use apply to our website as well as our applications, games, services, features, and content (collectively referred to as the “Services”), whether accessed or downloaded from the Website, third-party app stores, or other sources. Whenever you use the Services, you agree to be bound by all the terms and conditions of these Terms of Use. If you do not agree to these Terms of Use, you may not use the Services. Use of the Services in prohibited areas is void.
Please read these Terms of Use carefully, as they affect your legal rights and obligations. By registering for an account or otherwise using the Services, you represent that (1) you are at least 13 years old, (2) you understand and agree to these Terms of Use, and (3) if you are between the ages of 13 and 18, your legal guardian has reviewed and agreed to these Terms of Use. BeingDeveloper reserves the right to change or modify these Terms of Use at any time at its sole discretion. Any such changes or modifications will be effective immediately upon posting on the Services, and your continued use of the Services after any changes or modifications are posted will constitute your acceptance of and agreement to such changes or modifications. If you do not agree to any changes or modifications, your sole remedy is to stop using the Services. You agree that BeingDeveloper shall not be liable to you or any third party for any changes or modifications to these Terms of Use.
Unless otherwise expressly specified by BeingDeveloper for paid portions of the Services, BeingDeveloper reserves the right to add, change, suspend, or discontinue any aspect or feature of the Services or the Services themselves without notice or liability.
Subject to your compliance with these Terms of Use, BeingDeveloper grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for personal non-commercial purposes only, on one computer for the Website and on one device for BeingDeveloper’s applications, using and displaying the following content: (a) the portions of the Services available for free access from the BeingDeveloper Website, or (b) other portions of the Services available for paid access if you have paid the applicable fees and meet the applicable conditions. You may only transfer your account or portions of the Services from one device to another if explicitly authorized and enabled by BeingDeveloper through the Services. You may transfer the Services to a new device as long as you are the owner of both the old and new devices and the transferred account. Once the Services are transferred to the new device, they will automatically be deleted from the old device.
Except for your content (as defined below) and as otherwise expressly provided in these Terms of Use, BeingDeveloper and its licensors own and will retain all rights, title, and interest in and to the Services and the Service Materials. “Service Materials” refers to all information and materials related to the Services, including but not limited to: photographs; graphics; layouts; text; images; audio; video; designs; advertising copy; data; logos; domain names; trademarks, service marks, trade names, and other source identifiers; any and all copyrighted materials, including software; the “look and feel” of the Services or any part thereof; compilations, assemblies, and arrangements of materials related to the Services; and user content.
You acknowledge and agree that the Service Materials are protected by applicable intellectual property and other laws in the United States and other jurisdictions, and their use, reproduction, and distribution may be subject to these laws. All rights not expressly granted in these Terms of Use are reserved by BeingDeveloper and its licensors, and no license is granted by estoppel, implication, or otherwise. You agree not to interfere with, license, modify, publish, copy, sell, assign, transfer, transmit, or otherwise exploit any Service or Service Materials other than your content, nor attempt to do so, unless expressly permitted in writing by BeingDeveloper and the owners of such Service Materials.
You may only use the Services in locations where it is legal to do so.
As a condition of your use of the Services, without limiting any other obligations you may have under these Terms of Use, you agree to comply with the usage restrictions and rules set forth in this section and any other restrictions or rules specified in the Services (e.g., application-specific rules). The Services are for your personal and non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, reverse engineer, transfer, or sell any part of the Services, the use of the Services, or access to the Services for any commercial purpose, except for limited reverse engineering activities permitted by applicable law and only to the extent permitted by applicable law.
You agree not to use the Services to transmit, provide, or otherwise promote or support:
Any illegal, harmful, threatening, abusive, harassing, infringing, defamatory, vulgar, obscene, sexual, libelous, invasion of privacy, hateful, discriminatory, or otherwise objectionable or inappropriate user content;
Any user content that promotes illegal activities (e.g., drug use);
Any spyware, passive collection mechanisms, or any other code or materials that act as passive or active information collection or transmission mechanisms;
Deceptive, hacking, cracking, malware, viruses, or any other computer code, files, or programs that have or are intended to modify, damage, destroy, disrupt, or limit the functionality of the Services or any part thereof, control any computer software, hardware, or telecommunications equipment, or disrupt any user’s uninterrupted use and enjoyment of the Services; or
Unreleased content of the Services (e.g., in-game items or devices), areas unlocked by intruding customer data files, or data that cannot be obtained through normal operation or gameplay of any part of the Services.
These Terms of Use will remain in effect until terminated by either party. You may terminate these Terms of Use at any time for any reason by: (a) uninstalling the BeingDeveloper application (or, if you have not installed any BeingDeveloper application, emailing BeingDeveloper at [email protected] to notify them of your termination); (b) deleting or otherwise destroying all materials related to the Services; (c) ceasing to use the Services.
